By using the website and placing an order, the Customer confirms that they have read, understood, and fully accepted these Terms and Conditions.

1. Definitions

  • Customer – any individual or legal entity that accesses www.tomesim.com, places an order and/or uses the products offered.
  • Product – an eSIM (digital mobile data SIM) delivered electronically by email.
  • Order – a request submitted by the Customer through the website for the purpose of purchasing one or more digital products.
  • Contract – the distance contract concluded between the Seller and the Customer when the Seller confirms the Order.

2. Subject of the Contract

The subject of the Contract is the provision of digital eSIMs that provide access to mobile data services within the European Union, in accordance with the specifications stated on the relevant product page.

3. Registration on the Website

The Customer may place orders without creating an account or by registering a user account.

The Customer is responsible for ensuring that all information provided (email address, name, phone number) is accurate, as the eSIM is delivered exclusively in digital format via email.

4. Prices and Payments

All prices displayed on the website are expressed in Romanian Lei (RON) and include VAT.

Payment is made online by card through a secure payment processor.

The Order is considered confirmed once the payment has been successfully processed.

5. Delivery

Products (eSIMs) are delivered exclusively in digital format to the email address provided when placing the Order.

Delivery usually takes no more than 5 minutes after payment confirmation. However, delays may occur due to technical circumstances beyond the Seller’s control.

6. Right of Withdrawal

In accordance with Romanian Government Emergency Ordinance no. 34/2014 (OUG 34/2014), the 14-day right of withdrawal does not apply to digital products supplied immediately where performance has begun with the consumer’s express consent.

By completing the Order, the Customer accepts the loss of the right of withdrawal once the eSIM has been activated.

7. Warranty and Support

If the eSIM does not function as described, the Customer must contact our support team at tomesim@gmail.com within 48 hours of receiving the Product.

The Seller will investigate the issue and, if an error is confirmed, will provide a replacement or a partial/full refund, as appropriate.

8. Customer Responsibilities

The Customer is responsible for correctly installing and using the eSIM in accordance with the instructions provided.

The Seller shall not be held responsible for:

  • incompatible devices;
  • use outside the countries covered by the Product;
  • accidental deletion of the QR code;
  • issues caused by local mobile network operators.

9. Limitation of Liability

The Seller does not guarantee uninterrupted operation of the website and shall not be liable for losses caused by technical errors, temporary service interruptions, or external factors, including mobile networks, internet service providers, or other circumstances beyond the Seller’s reasonable control.

10. Intellectual Property

All website content, including texts, images, logos, and trade names, is the property of WRK EDY MEDIA SRL.

Copying, modifying, reproducing, distributing, or otherwise using such content without the owner’s prior written consent is prohibited.

11. Processing of Personal Data

12. Dispute Resolution

Any dispute or disagreement shall first be resolved amicably whenever possible.
